These terms and conditions govern your use of commlyco.com and all associated services operated by CommlyCo. By accessing or using our website, registering an account, or engaging with any of our services, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. About CommlyCo

CommlyCo is a social-first B2B supply chain media platform that connects factories and manufacturers with founders and brand builders. We produce behind-the-scenes content about the supply chain industry and operate a factory directory at commlyco.com.

References to “CommlyCo”, “we”, “us” or “our” mean CommlyCo.

References to “you” or “your” mean any person or entity accessing or using our website or services, including founders, brand builders, factories, and manufacturers.

References to “factory” or “manufacturer” mean a business that has registered a profile on CommlyCo’s directory, whether on a free Listed plan or a paid Partner or Featured plan.

References to “founder” or “brand builder” mean a person or business using CommlyCo to discover and connect with factories.

2. Acceptance of Terms

By using commlyco.com, you confirm that:

  • You are at least 18 years old
  • You have the authority to agree to these terms on behalf of yourself or your organisation
  • You will use our services in accordance with these terms and all applicable laws

3. Our Services

CommlyCo provides the following services:

  • Content platform — articles, videos, and editorial content about the supply chain industry and brand building, available to all visitors
  • Factory directory — a searchable database of factory and manufacturer profiles
  • Founder access — registered founders can contact factories directly through the platform
  • Factory listing plans — Listed (free), Partner (paid), and Featured (paid) tiers for factories to promote their business on CommlyCo
  • Educational resources — guides, playbooks, and newsletters for founders and brand builders

4. Accounts and Registration

Founders and brand builders You may register a free account to contact factories through the platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Factories and manufacturers You may register a free Listed account or upgrade to a paid Partner or Featured plan. See Section 9 for full details of paid plans.

All users You must provide accurate, complete, and current information when registering. You must not impersonate another person or entity. CommlyCo reserves the right to suspend or terminate any account at any time for any reason, including breach of these terms.

5. Content on CommlyCo

Our content All articles, videos, graphics, and other content produced by CommlyCo is owned by CommlyCo and protected by copyright. You may not reproduce, distribute, or commercialise our content without our prior written permission. Sharing links to our content on social media is encouraged.

User-generated content If you upload content to CommlyCo — including factory profile descriptions, photos, videos, or any other materials — you grant CommlyCo an irrevocable, worldwide, royalty-free licence to use, display, distribute, and promote that content across all CommlyCo platforms and channels.

By uploading content, you confirm that:

  • You own or have the right to use the content
  • The content does not infringe any third-party intellectual property rights
  • The content is accurate and not misleading
  • The content does not contain anything unlawful, defamatory, or offensive

CommlyCo reserves the right to remove any user-generated content at any time without notice.

6. Acceptable Use

You agree not to use CommlyCo to:

  • Post false, misleading, or fraudulent information
  • Impersonate any person, business, or entity
  • Scrape, harvest, or extract data from the platform without permission
  • Send unsolicited commercial messages to other users
  • Attempt to gain unauthorised access to any part of our systems
  • Use the platform for any unlawful purpose
  • Post content that is defamatory, discriminatory, or offensive
  • Interfere with or disrupt the operation of our services

CommlyCo reserves the right to suspend or terminate access for any user who breaches these terms.

7. The Factory Directory

Listed factories (free) CommlyCo may create a basic factory profile on behalf of a factory that has registered its interest, subject to review and approval. Listed profiles appear in the directory and can receive founder enquiries forwarded by email.

Accuracy of profiles Factories are responsible for ensuring their profile information is accurate and up to date. CommlyCo does not independently verify all information provided by factories and accepts no liability for inaccurate profile content.

Profile removal CommlyCo reserves the right to edit, suspend, or permanently remove any factory profile at any time and without prior notice, including where:

  • The factory has provided false or misleading information
  • The factory has engaged in fraudulent or deceptive practices
  • The factory has received credible complaints from founders or buyers
  • Continued listing would be damaging to CommlyCo’s reputation or users
  • The factory’s listing violates these terms or applicable law

8. Enquiries and Transactions

CommlyCo facilitates introductions between factories and founders. We are not a party to any transaction, agreement, or deal that results from those introductions.

CommlyCo takes absolutely no responsibility for any deals, orders, contracts, disputes, payments, or transactions that occur between factories and founders, whether initiated through the platform or otherwise.

All commercial arrangements between factories and founders are entirely the responsibility of the parties involved. CommlyCo strongly recommends that all parties conduct their own due diligence before entering into any commercial agreement.

CommlyCo does not verify the identity, legitimacy, or creditworthiness of founders or buyers who make enquiries through the platform.

9. Factory Listing Plans — Partner and Featured

9.1 Plans overview

CommlyCo offers three listing tiers for factories:

  • Listed — Free: Basic profile in the directory, appears in search, founder enquiries forwarded by email. Subject to CommlyCo review and approval.
  • Partner — £49: One-time payment. Includes self-service profile editing, up to 10 photo uploads, full enquiry inbox in the factory portal, founder contact details, and priority placement in search results.
  • Featured — £149/month + one-off production fee: Includes everything in Partner plus a behind-the-scenes video shoot at your facility, content published across CommlyCo’s social channels (TikTok, Instagram, YouTube), a CommlyCo Verified badge, and featured placement at the top of search results.

All registrations are subject to review. CommlyCo reserves the right to decline any registration without providing a reason.

9.2 Payment

All prices are quoted in GBP and are exclusive of VAT where applicable.

Partner (£49): Payment is due in full at the time of sign-up. Access to Partner features begins immediately upon payment confirmation.

Featured (£149/month): The monthly subscription fee is billed in advance on a rolling monthly basis. The one-off production fee is agreed separately on a call prior to confirming the shoot and is invoiced separately.

All payments are processed securely through our payment provider. CommlyCo does not store card details.

9.3 Refunds

Partner: All payments are final. No refunds are offered on the Partner plan under any circumstances, including but not limited to non-use of features, dissatisfaction with the service, or profile removal due to breach of these terms.

Featured — monthly subscription: No refunds are issued for partial months. If you cancel mid-month, access continues until the end of the current billing period.

Featured — production fee: A deposit of 50% of the agreed production fee is required to confirm the shoot date. If CommlyCo cancels the shoot for reasons within our control, the full deposit will be refunded. If CommlyCo cancels for reasons outside our control (force majeure, travel disruption, safety concerns), a partial refund will be assessed on a case-by-case basis.

9.4 Cancellation

Partner (once subscriptions are introduced): Cancellation requires 30 days’ written notice to info@commlyco.com. Access to Partner features continues until the end of the 30-day notice period. No refund is issued for any remaining days.

Featured — monthly subscription: Cancellation requires 30 days’ written notice to info@commlyco.com. Access continues until the end of the notice period.

To cancel, email info@commlyco.com with the subject line “Cancellation Request — [Your Factory Name]”.

9.5 Featured shoot cancellation policy

Once a shoot date is confirmed and a deposit paid, the following cancellation policy applies:

Cancellation by the factory more than 14 days before the shoot date 25% of the agreed production fee will be refunded. The remaining 75% of the deposit is retained by CommlyCo as a cancellation fee to cover planning, crew scheduling, and preparation costs already incurred.

Cancellation by the factory within 14 days of the shoot date No refund. The full deposit is retained by CommlyCo. This reflects the cost of committed crew, travel, and equipment arrangements that cannot be recovered at short notice.

No-show on shoot day If the factory facility is unavailable or inaccessible on the confirmed shoot date without prior notice, this is treated as a cancellation within 14 days. No refund will be issued.

Rescheduling If you need to reschedule, please contact us at least 14 days in advance. CommlyCo will do its best to accommodate a new date, subject to availability. Rescheduling is at CommlyCo’s discretion and does not constitute a cancellation. Rescheduling within 14 days of the shoot date may be treated as a cancellation and the cancellation policy above will apply.

9.6 Content ownership

Uploaded content: Any content uploaded to your factory profile — including text, photos, and documents — becomes the property of CommlyCo upon upload. CommlyCo is granted an irrevocable, worldwide, royalty-free licence to use, display, distribute, and promote that content across all CommlyCo platforms and channels.

Video content (Featured): All video content produced by CommlyCo during a factory shoot — including raw footage, edited videos, and derivative content — is owned exclusively by CommlyCo.

The factory is granted a non-exclusive, non-transferable licence to use the produced video content for its own marketing and promotional purposes, provided this right is expressly agreed upon during the production call prior to the shoot and confirmed in writing by CommlyCo.

The factory may not sell, sublicence, or transfer the video content to third parties without prior written consent from CommlyCo.

10. Free Resources — Canton Fair Playbook and Other Downloads

CommlyCo may offer free downloadable resources, guides, and playbooks. By downloading these resources, you agree to receive CommlyCo’s email newsletter. You may unsubscribe at any time. Download links are personal, time-limited, and for your own use only. You may not redistribute or sell any free resource provided by CommlyCo.

11. Privacy

Your use of CommlyCo is also subject to our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand our practices regarding your personal data.

12. Third-Party Links

CommlyCo may contain links to third-party websites and services. We have no control over these and accept no responsibility for their content, accuracy, or practices. Linking to a third-party site does not constitute an endorsement by CommlyCo.

13. Disclaimer of Warranties

CommlyCo is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the availability, accuracy, reliability, or suitability of our services for any particular purpose.

We do not warrant that:

  • The platform will be uninterrupted or error-free
  • Any factory profile information is accurate or current
  • Enquiries submitted through the platform will result in any commercial outcome

14. Limitation of Liability

To the fullest extent permitted by law, CommlyCo’s total liability to you in connection with these terms or your use of our services shall not exceed the greater of £100 or the total amount you have paid to CommlyCo in the 12 months preceding the claim.

CommlyCo is not liable for any indirect, consequential, incidental, special, or punitive losses, including but not limited to loss of revenue, loss of business, loss of data, or loss of anticipated savings, even if CommlyCo has been advised of the possibility of such losses.

Nothing in these terms excludes or limits CommlyCo’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by English law.

15. Indemnity

You agree to indemnify and hold CommlyCo harmless from any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these terms, your use of our services, or any content you upload or submit through the platform.

16. Changes to These Terms

CommlyCo may update these terms from time to time. When we do, we will update the date at the top of this page. Where changes are material, we will notify registered users by email. Your continued use of our services after any changes constitutes your acceptance of the updated terms.

17. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
